Cotemar has filed an action in the Supreme Court of the State of New York seeking recognition of a Mexican judgment against ABSG Consulting, with the Mexican offshore services company calculating that the amount due has reached $59.4 million including interest.
The underlying Mexican judgment ordered ABSG Consulting to pay $34.8 million plus interest for work carried out by Cotemar in connection with the transportation and installation of a modular drilling rig in the Gulf of Mexico. Cotemar announced the New York action on 26 August 2026.
The dispute dates to September 2017, when ABSG Consulting retained Cotemar to provide personnel, equipment and logistical support for the rig transportation and installation work on an offshore platform. Cotemar completed the contracted work by March 2018.
According to the findings described in the Mexican proceedings, ABSG Consulting issued signed certificates confirming that the work had been performed satisfactorily and in accordance with the contract.
Payment was not made to Cotemar. ABSG Consulting maintained that it was discussing payment with prime contractor Tamaulipas Modular Rig. The Mexican courts subsequently found that Tamaulipas Modular Rig had paid ABSG Consulting in full under their agreement, with bank transfer records submitted during the proceedings.
Cotemar filed suit against ABSG Consulting in Mexico City in July 2018. On 30 March 2022, the trial court ruled in favor of Cotemar, finding that the work had been satisfactorily received, that Tamaulipas Modular Rig had paid ABSG Consulting for the work covered by their agreement, and that ABSG Consulting had acknowledged the debt.
The case was appealed, but the Collegiate Appellate Court rejected ABSG Consulting‘s grounds for appeal and upheld the judgment in June 2023.
A separate U.S. federal court record shows that ABSG Consulting filed a marine contract action against Tamaulipas Modular Rig in the U.S. District Court for the Southern District of New York on 2 October 2018. The case, No. 1:18-cv-09000, was voluntarily dismissed without prejudice on 29 November 2018. The docket does not establish liability in the current Cotemar proceeding.
The latest New York action concerns recognition of the Mexican judgment. Cotemar says the total amount it is seeking has reached $59.4 million after interest under Mexican and New York law.
